IRS OFFER IN COMPROMISE HELP
After 35 years and thousands of tax cases Joe mastriano, CPA offers you the following information. He cautions you, “Do not attempt to do an offer on your own, unless you can’t afford a few thousand dollars for top level professional CPA help”. Never hire a non professionally licensed firm. Law firms and CPA firms are the only qualified professionally licensed firms. Be careful, you will be lied to by debt relief companies who hire CPAs and attorneys to work for them. The company will not be licensed, and you will have no recourse after you find out you were lied to.
It’s always best to do a consultation first from someone who has many years and cases similar to yours so you can gain knowledge concerning the options toward tax resolution. Let’s start with a message from the IRS… and be careful as the IRS only publishes what they want you to know, not the complete “story” of what you should know.
Many people think that the solution to owing a large tax liability is filing an offer. It’s like trying to be your own doctor. Solving IRS problems requires knowledge and experience to diagnose the best solution for your circumstance. An offer is just one tool that gets used along with others.
Important Notice 2017 Offer in Compromise Notice
Beginning with Offer applications received on or after March 27, 2017: The IRS will return any newly filed Offer in Compromise application if you have not filed all required tax returns. Any application fee included with the OIC will also be returned. Any initial payment required with the returned application will be applied to reduce your balance due. This policy does not apply to current year tax returns if there is a valid extension on file.
What is an Offer in Compromise?
Here the IRS is leaving out the other two options for doubt as to liability (and how to use it effectively) and the elusive third one. Please consult the form 656 and instructions. Or go to http://www.taxproblem.org and ask us to tell you what else you need to know to help you actually get an offer approved, or better yet how to resolve your tax matter.There may be a better solution than an offer.
We generally approve an offer in compromise when the amount offered represents the most we can expect to collect within a reasonable period of time. Explore all other payment options before submitting an offer in compromise. The Offer in Compromise program is not for everyone.
Reasonable? They will often extend the payments over the remaining life of the collection statute causing an offer amount to be way higher than the amount you owe!

Steps to Take
Make sure you are eligible
Before we can consider your offer, you must be current with all filing and payment requirements.

You are not eligible if you are in an open bankruptcy proceeding. Use the Offer in Compromise Pre-Qualifier to confirm your eligibility and prepare a preliminary proposal.
Submit your offer
You’ll find step-by-step instructions and all the forms for submitting an offer in the Offer in Compromise Booklet. Your completed offer package will include:
- Form 433-A (OIC) (individuals) or 433-B (OIC) (businesses) and all required documentation as specified on the forms;
- Form 656(s) – individual and business tax debt (Corporation/ LLC/ Partnership) must be submitted on separate Form 656;
- $186 application fee (non-refundable); and
- Initial payment (non-refundable) for each Form 656.
Select a payment option
Your initial payment will vary based on your offer and the payment option you choose:
- Lump Sum Cash: Submit an initial payment of 20 percent of the total offer amount with your application. Wait for written acceptance, then pay the remaining balance of the offer in five or fewer payments.
- Periodic Payment: Submit your initial payment with your application. Continue to pay the remaining balance in monthly installments while the IRS considers your offer. If accepted, continue to pay monthly until it is paid in full.
If you meet the Low Income Certification guidelines, you do not have to send the application fee or the initial payment and you will not need to make monthly installments during the evaluation of your offer. See your application package for details.
Understand The Offer In Compromise Process
While your offer is being evaluated:
- Your non-refundable payments and fees will be applied to the tax liability (you may designate payments to a specific tax year and tax debt);
- A Notice of Federal Tax Lien may be filed;
- Other collection activities are suspended;
- The legal assessment and collection period is extended;
- Make all required payments associated with your offer;
You are not required to make payments on an existing installment agreement;
“wait a minute here, if you default an agreement and the offer division doesn’t assign your case to an offer specialist right away, who contacts collections to put a hold on, you will suffer collection action, such as a bank or wage levy.” Says Joe Mastriano, CPA
- Your offer is automatically accepted if the IRS does not make a determination within two years of the IRS receipt date.
If your offer is accepted
- You must meet all the Offer Terms listed in Section 8 of Form 656, including filing all required tax returns and making all payments;
- Any refunds due within the calendar year in which your offer is accepted will be applied to your tax debt;
- Federal tax liens are not released until your offer terms are satisfied; and
Certain offer information is available for public review at designated IRS offices
If your offer is rejected
- You may appeal a rejection within 30 days using Request for Appeal of Offer in Compromise (PDF).
- The online self-help tool may provide additional assistance on appealing your rejected offer.
There are many factors the professional to goes through before attempting to settle with the IRS, it requires an understanding of how to navigate through IRS settlement guidelines that often have no fairness or reason. That’s where many years of experience comes in. Various ways of testing out solutions for removing the liability is just one step. There are various installment agreement options also available.
- Offer in Compromise is a fresh start from heavy tax debt, if you qualify.
- After the offer is given to an offer specialist to analyze and they send a stop code to collections. Your wages and bank accounts are no longer at risk of being garnished.
- After the 5 year period that an Offer in Compromise is complete, the IRS will release all related tax liens filed against you.
A comprehensive investigation by the IRS is required. They will investigate your finances before settling, you must disclose your income, expenses and assets including your house, cars, valuables and retirement accounts. The IRS will consider your unique set of facts and circumstances including your ability to pay, your income, expenses, and asset equity.
- The IRS will require the information about your current employment including the review of your paystubs, tax returns, bank statements, business profits and losses.
- While an Offer in Compromise is being investigated, the IRS clock to legally collect from you (10 years) stops running. In that regard, it can be a bad idea to try to settle when there are only a few years remaining for the IRS to collect. This is a consideration that requires very careful analysis of all transcripts involved.
- If the offer is accepted by the IRS, you will be put on a five-year probation, requiring full compliance in filing and payment of all taxes during that time. This is a very specific requirement that is needed to be fully understood, as the definitions for this are not as most people thin
- An Offer in Compromise can often take the IRS from 9-12 months to investigate. The IRS then allows for a 5-24 month period to pay the settlement amount to the IRS.
- It is harder to get qualified for an OIC if you are making credit card payments, or have a high monthly mortgage or car loan payment. The IRS may consider those payments in their settlement calculations.
- If the IRS determines they can collect the full amount you owe, your offer will be rejected.
- The IRS rejected 60% of the offers it received in 2016, consisting of 41,000 rejections out of 68,000 submissions.
Please review the instruction forms very carefully a few times so you can map out (I’m serious), you must layout a detailed plan and continue to fill in the gaps until you feel you have fully understood all of the steps and all of the requirements.
Again, I want to repeat that there are other options for tax relief. Everyone’s situation has some things that are unique– a compromise is not the only way to clear an IRS tax debt out of your life. The IRS can accept the fact that you owe the tax debt but not force you to repay it. This practice is also known as “currently not collectible (CNC)” debt, where the IRS puts you in their bad debt category and then leaves you alone. This is not to be used in place of a payment plan, but a good tool to use to toll the 10 year statute to collect taxes. Sometimes it makes more sense to let this time-frame expire than to file an offer in compromise.
This information is meant to make you think in more detail about what you are doing. Never blindly hire someone who says they will “take care of you”. Never blindly trust that the IRS
Will take care of you. Never hire someone who will give you a “discount” on professional fees. Offers require a lot of work and experience.
